TERMS & CONDITIONS (BetterBiz Group, LLC)

These Terms & Conditions (“Terms”) govern your access to and use of the websites and services provided by BetterBiz Group, LLC (“BetterBiz,” “we,” “us,” “our”), including betterbizgroup.com, BetterBiz CRM, BetterBiz AI Agents (voice and chat), BetterBiz Gatekeeper, BetterBiz Magazine subscriptions, and related content, events, and communications (collectively, the “Services”).

By accessing or using the Services, you agree to these Terms. If you use the Services on behalf of a company or other entity, you represent that you have authority to bind that entity to these Terms.

2) Privacy Policy

Your use of the Services is also governed by our Privacy Policy (“Privacy Policy”). If there is a conflict between these Terms and the Privacy Policy on a privacy topic, the Privacy Policy controls for that topic.


3) Eligibility and Accounts

You must be at least 18 years old to use the Services. You agree to provide accurate account information and keep it current. You are responsible for safeguarding your login credentials and for all activity under your account.


4) Services; Changes

We provide software and services that may include CRM and automation tools, AI voice/chat agents, call screening and notifications, messaging tools, and event/content experiences. We may add, modify, or discontinue any part of the Services at any time.


5) Customer Data; Your Responsibilities

Customer Data” means any data, content, contact lists, scripts, prompts, files, messages, or other information you submit to or process through the Services.

You are responsible for:

  • Obtaining and maintaining all rights, permissions, and legally required consents for Customer Data and for contacting end users (including by phone, SMS, and email).

  • Complying with applicable laws and industry rules (including privacy, telemarketing/texting, consumer protection, and carrier requirements).

  • Keeping opt-out and suppression lists current and honoring opt-outs promptly.

You represent and warrant that your Customer Data and your use of the Services do not violate any law or third-party rights.


6) AI Agents; Recording and Transcription

When you interact with (or deploy) BetterBiz AI Agents, calls/chats may be recorded and transcribed for quality assurance, training, and support. Where required by law, you are responsible for ensuring appropriate notice and consent is provided before recording.

AI Output Disclaimer: AI-generated outputs may be inaccurate, incomplete, or inappropriate. You are responsible for reviewing and validating outputs before relying on them, using them operationally, or sharing them with end users.


7) SMS/Text Messaging Terms (Transactional Alerts)

BetterBiz CRM and BetterBiz Gatekeeper SMS/text messages are intended for transactional/operational alerts only (for example: call screening alerts, call notifications, confirmations, reminders, requested updates, and support-related notices). They are not intended for outbound marketing campaigns sent through those products.

If you send or receive SMS/text messages using the Services, you agree to the following:

a) Consent and compliance
You will only message recipients who have provided valid consent as required by law and carrier rules, and you will maintain records of consent and opt-out status.

b) Opt-out and help
Opt-out: Recipients can opt out of SMS/text messages at any time by replying STOP. After opt-out, a recipient may receive one final confirmation message acknowledging the request.
Help: Recipients can reply HELP for basic program help or contact info@betterbizgroup.com.

c) Frequency and rates
Message frequency varies. Message and data rates may apply based on a recipient’s mobile plan.

d) Carrier notice
Wireless carriers are not liable for delayed or undelivered messages.

e) Mobile data sharing
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Mobile information may be shared with service providers that help us deliver text messages and provide support services.


8) Fees, Billing, Auto-Renewal, and Taxes

a) Monthly subscription; pricing
Subscriptions are billed monthly and start at $199 per month, plus applicable taxes (if any).

b) Auto-renewal
Your subscription automatically renews each month unless you cancel before your next billing date. By subscribing, you authorize BetterBiz (and our payment processor) to charge your payment method on a recurring basis.

c) SMS included and overages
Each monthly subscription includes 2,000 SMS messages per month. Any usage above the included amount will be charged as an overage at $0.03 per SMS.

d) SMS rate
SMS usage is priced at $0.03 per SMS (including overages). SMS may appear as a separate usage line item on your invoice/receipt.

e) Invoices and receipts
Invoices and receipts are sent automatically via email.


9) Payments; Payment Processing

Subscription charges are processed automatically via Stripe. BetterBiz does not intentionally store full payment card numbers on its systems.


10) No Refunds; Cancellation

a) No refunds
All payments are non-refundable, including prepaid or partially used months.

b) Cancel anytime
You may cancel at any time. Cancellation stops renewal immediately, and your access to the Services will remain active through the end of your current paid monthly billing period. You will not be billed for the next month after cancellation.


11) Marketing Communications (Email)

We may send service-related communications (for example: confirmations, reminders, requested updates, and important notices). We may also send marketing communications by email where permitted; you can opt out of promotional emails by using the unsubscribe link in our emails. We may still send non-promotional messages such as receipts or critical service notices.


12) Sponsors; Events; Sponsored Content

If you download sponsored content, click a sponsored email, or attend a sponsored event, we may share your submitted information with the named sponsor so they can follow up with you about the relevant offering, and we will identify the sponsor in that context.


13) Cookies; Analytics

We use cookies and analytics tools (including Google Analytics) to understand site usage and improve performance. You can control cookies through your browser settings; disabling cookies may affect functionality.


14) Third-Party Services and Integrations

The Services may integrate with third-party providers (for example: hosting, CRM/marketing tools, analytics, payment processing, AI calling/chat/transcription, messaging providers). Third-party services are subject to their own terms and policies, and BetterBiz is not responsible for third-party outages, pricing changes, or policy changes.


15) Data Retention

We generally retain leads, communications, SMS records (including opt-in/opt-out logs), and AI Agent call recordings/transcripts for 1 to 3 years, unless a longer period is required for legal/accounting/dispute reasons, or you request deletion where applicable and we are able to comply.


16) Acceptable Use

You agree not to:

  • Use the Services for unlawful, deceptive, abusive, defamatory, or harmful activity.

  • Send spam or unsolicited communications, or violate opt-out requirements.

  • Attempt unauthorized access, interfere with system integrity/security, or introduce malware.

  • Infringe intellectual property or privacy rights.

We may suspend or terminate access if we reasonably believe you are violating these Terms, violating law, or creating legal/compliance risk.


17) Intellectual Property

BetterBiz owns the Services, software, branding, and content we provide (excluding Customer Data you submit). Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to use the Services during your subscription/usage term.

You may not copy, reverse engineer, resell, sublicense, or exploit the Services except as expressly permitted in writing.


18) Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, BETTERBIZ DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee uninterrupted service, perfect deliverability, or specific outcomes (including leads, conversions, or revenue).


19) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BETTERBIZ WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BETTERBIZ’S TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNTS PAID BY YOU TO BETTERBIZ FOR THE SERVICES IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.


20) Indemnification

You agree to indemnify and hold harmless BetterBiz from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from:

  • Your Customer Data, messaging practices, campaigns, scripts, or content;

  • Your failure to obtain legally required consents or provide legally required notices;

  • Your violation of these Terms or applicable law; or

  • Your use of the Services in a way that infringes or violates the rights of others.


21) Changes to These Terms

We may update these Terms from time to time by posting an updated version and revising the Effective Date. Your continued use of the Services after changes become effective means you accept the updated Terms.


22) Governing Law; Venue

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Venue for disputes will be in state or federal courts located in Texas, unless we agree otherwise in writing.


23) Miscellaneous

  • Severability: If any provision is unenforceable, the remaining provisions remain in effect.

  • No Waiver: Failure to enforce a provision is not a waiver.

  • Assignment: You may not assign these Terms without our written consent. We may assign these Terms as part of a merger, acquisition, financing, or sale of assets.

  • Entire Agreement: These Terms and the Privacy Policy are the entire agreement between you and BetterBiz regarding the Services.
